Wow, this is very interesting. I thought I was in the clear when it came to having trouble finding a place to live because of a Pit Bull. What makes my situation a little more difficult is that I don't actually have the dog.
Now does anyone know if there is a way to view the by-laws of a complex online?

The inspection at the house in Nutley didn't go well, and my bro and the owner went back and forth many times, but couldn't come to an agreement. There was a LOT of work that had to be done, major work...and the owner wouldn't lower the price enough, or do the repairs first, so it fell through. It would have been sweet because there was a separate little apartment set up on the property...so I coulda lived there. Bummer.

HOA rules overrule any state or judge.. you will lose fighting an HOA

as long as the HOA has their bylaws in writing you cant win. any addendums must be added to the bylaws and voted on. anything in writing in the bylaws is law, no matter what a judge says. HOA;s can make you change your house color if it doesnt fit the bylaws. my friend lived in a lake community and didnt know there were bylaws until after she signed a year lease. the bylaws stated that all renters were NOT allowed to use the roads for pleasure, and were only allowed to drive in and out onthe roads to go to work, were not allowed to walk dogs on the roads/grass, and they upheld the laws when they saw her walking her dogs one night. due to signing a year lease she was stuck between a rock and hard place, as she couldnt break her lease due to the lease wording, and she couldnt walk her dogs onthe road, so she had to load them in her truck every day to go run them, and could only potty them in the rented house's backyard.... HOA;s are very very strict, and to fight them is a losing battle as people never win... whatever the bylaws state is what goes..

Yeah ok we are on the same page they can not enforce something they do not like unless it is in writing. They could not have told me to get rid of Harley simply cause they were afraid of her. They could have re-written the by-laws for future residents but i would imagine Harley would have been grandfathered in.
Kev if the need should arise just ask the real estate agent to provide you with a copy.

if they really wanted to they could have rewritten the bylaws and kicked harley out... their rules are their own, and if you got an attorney you would still probably lose unfortunately.. HOA;s dont grandfather ANYTHING or any dog in, and if they do grandfather anything in there will be a ton of rules for whatever is grandfathered in

Good luck on the search...I'm about to face this dilemma myself. I'm currently renting in a small co-op in Manhattan with no "written" restrictions, and so far everyone I've encountered in the building has been very friendly and sociable with my dog. However, I'm going to be moving to Philly in a month and most of the "really dog friendly" rental buildings have breed restrictions.
I'm on the fence about buying or renting, but as I research the market I'm finding a ton of seemingly nice townhomes in my preferred area at affordable prices. Fortunately I am able to temporarily move into my parents' house to save some $$...it will be great for my dog to have a bigger home with a great yard while I look for a house...and I can take my time and make a decision.
