TN introduces ban on pit bull - includes AmStaff

Senate Bill 2738 filed for introduction 1/14/08
"Creates a class A misdemeanor of knowingly owning a pit bull in this state"

The expanded version of the bill defines pit bull:
(2) "Pit bull dog" means any pit bull terrier; and

(3) "Pit bull terrier" means any American pit bull terrier, Staffordshire
bull

terrier, American bulldog or American Staffordshire terrier breed of dog or
any

mixed breed of dog which contains as fifty percent (50%) of its breeding the

breed of American pit bull terrier, Staffordshire bull terrier, American
bulldog or

American Staffordshire terrier, so as to be identifiable as partially of the
breed

American pit bull terrier, Staffordshire bull terrier, American bulldog or
American

Staffordshire terrier.

(b) It is an offense for any person to knowingly own a pit bull dog in this
state.

(c) A violation of this section is a Class A misdemeanor.

(d) In addition to the penalty imposed in subsection (c), the court making
the

sentencing determination for a person convicted under this section shall
order the

person convicted to surrender custody and forfeit the pit bull dog or pit
bull dogs if the...

SB 2738 would make it a Class A misdemeanor to own a pit bull.

"My purpose of this bill is actually to raise the awareness that something needs to be done," said Sen. Tommy Kilby, D-Wartburg.

The senator says the idea for the bill came after Jennifer Lowe was killed by pit bulls in Knox County in November. He also lost a friend to a pit bull about two years ago.

"If you put yourself in the place of these families that have lost loved ones and have had loved ones injured because of dogs such as the pit bulls, and that's what dogs now are doing this most, then certainly you would want something done about it," he said.

But Tim Adams, executive director at the Young-Williams Animal Center, says breed-specific laws just won't work.

"The reality is, they're not all bad," Adams said. "There's just no way that any one of those animals that lives in the state of Tennessee is a bad animal."

As it turns out, Senator Kilby agrees.

He said Thursday night he plans to back down on banning all pit bulls and amend the bill, adding he simply wanted to file some sort of legislation about dangerous dogs before Thursday's filing deadline.

"It will be to say that if you own one of these dogs, whether it's a pit bull or whether it's some other vicious dog that has been made to be vicious and to have the propensity to do bodily harm to human beings, that you need to be responsible for it," he said.

Did you know... being a spectator at a dog fight is only a CLASS C MISDEMEANOR in Tennessee? The passing of SB2738 would make being a responsible "pit bull" owner a more severe crime and inflict harsher penalties than actually knowingly PARTICIPATING in a true crime!

Tennessee Senator Tommy Kilby has proposed a bill that, if passed, would deem pit bull ownership as a Class A Misdemeanor.

According to the expanded version of the bill, pit bull is defined as:

The original bill SB2738 was withdrawn on January 18th. Senator Kilby introduced a new bill, SB3827, which was filed on January 17th. According to a representative from Bless the Bullys: Pit Bull Rescue & Education, who has spoken with Sentor Kilby's Assistant, the difference between the two bills is this:

-The Chapter and Title that the bill refers to


By changing the Chapter and Title it, "...allows Senator Kilby to make broader, more sweeping changes to the bill. SB3827 affects Titles 39 and 44 and, as such, it opens the bill to a wider array of modifications", says Jodi Preis of Bless the Bullys.


She also goes on to say that she was assured by the assistant that the breed specific legislation will eventually be removed from the bill to allow for a dangerous dog law.


According to an article from the Memphis Commerical Appeal, Senator Kilby has no interest in really passing a ban on pit bulls, he is interested in changing the legislation to push for a new, better dangerous dog law.
