This actually varies by state and sadly some states have no guidelines at all, while others don't seem to really enforce them from hat I've observed with people posting about getting pups way too young IMO. Here ya go: www.animallaw.info/articles/ovuspuppysaletable.htm

It probably means there are no laws in that state. Whatever the laws are, a puppy should not leave the mom until it is weened and at least 8 weeks old. Same with kittens and most other pets.

That sucks. People around here give away or sell puppies away at birth practically (NC). What amazes me is that people are REQUESTING puppies that young. We're like sorry, um, you arent even looking at any of our adoptable pups until they are 8 weeks! Then I have to explain to them if they were to get a puppy that young the socialization, health, and behavior issues it's likely to have. They are always so surprised by that.

If the two parties were happy with the transaction, it would be difficult for the state to prove that it was a sale, especially if cash were involved. Difficult proof=more costs to enforce, and I do not see that happening in an economic climate where some states are actually releasing prisoners early and utilizing ineffective halfway houses because of cost issues.
